VI. Information collected automatically. When you use the Website, we and our service providers may collect IP address, browser and device information, referring and exit pages, pages viewed, links clicked, dates and times of visits, approximate location derived from IP address, and cookie or similar technology information.
VII. Information from others. We may receive information from parents or guardians, schools, nonprofit organizations, community partners, service providers, public sources, and other lawful sources relevant to our programs, partnerships, communications, or operations.
VIII. Biometric information (BIPA). Wayfarer Pathways does not collect biometric identifiers or biometric information as defined by the Illinois Biometric Information Privacy Act (BIPA), 740 ILCS 14/1 et seq. Photographs, video recordings, and audio recordings are not treated as biometric identifiers or biometric information unless they are used to identify an individual through a scan of face geometry, voiceprint, or another technology covered by BIPA. If our practices change and we collect biometric identifiers or biometric information, we will comply with BIPA, including applicable notice, consent, retention, destruction, security, and disclosure requirements. We do not sell, lease, trade, or otherwise profit from biometric identifiers or biometric information.

We collect this information from you directly; automatically through the Website and related technologies (as described in Section VI); and from the other sources described in Section VII (Information from others), including parents or guardians, schools, nonprofit organizations, community partners, service providers, and public or other lawful sources.
X. Sensitive information. To the extent we collect information that may be considered sensitive under applicable law, including information relating to a minor, we use and disclose that information only as reasonably necessary for the purposes described in this Privacy Policy and as permitted by law and, where required, with appropriate notice or consent.
Article 3 — How We Use Personal Information
I. Website and communications. We use personal information to operate, maintain, secure, and improve the Website; respond to questions and requests; provide updates; administer forms; and communicate about our work.
II. Youth programs. We use information to review interest or applications, communicate with participants and parents or guardians, coordinate schedules and activities, provide accommodations, protect participant safety, document participation, evaluate programs, and comply with legal and program requirements.
III. Philanthropy and community partnerships. We use information to identify and evaluate prospective partners, review funding interests or proposals, conduct appropriate diligence, administer grants or collaborative projects, communicate with partner representatives, evaluate impact, and maintain records.
IV. Events and outreach. We may use information to organize events, manage attendance, share program or event updates, document our work, and, where permitted, create educational, archival, promotional, or social media materials.
V. Analytics, security, and legal purposes. We may use information to understand Website use and communication effectiveness; prevent fraud, misuse, or security incidents; enforce our terms and policies; protect rights, property, health, and safety; comply with law; and maintain appropriate business records.
VI. Other disclosed purposes. We may use personal information for another purpose explained when it is collected or with your consent.
VII. Analytics and advertising. We may use personal information to understand how the Website and our communications are used and to evaluate the effectiveness of our outreach. We do not use personal information for targeted or cross-context behavioral advertising except as described in this Privacy Policy; any use of information for targeted advertising, and the choices available to you, is addressed in Article 7 (Your Choices and Privacy Rights).
VIII. Legal bases and permitted purposes. Where required by applicable law, we use personal information only where we have a lawful basis or permitted purpose to do so, such as your consent, the performance of a program, event, or activity you request, our legitimate organizational and philanthropic interests, or compliance with a legal obligation.
IX. Purpose limitation. We will not use personal information for purposes that are materially different from those disclosed in this Privacy Policy, or from the purposes disclosed when the information was collected, without first providing notice or obtaining your consent as required by applicable law.
Article 4 — How We Share Personal Information
I. Service providers. We may share personal information with vendors that support website hosting, forms, email communications, data storage, analytics, security, event administration, program operations, document management, and similar functions. Where appropriate or required by applicable law, we use contractual terms designed to restrict these vendors from using, retaining, or disclosing personal information except to perform services for us or as otherwise permitted by law. This is different from disclosures to third parties that act for their own purposes, which we make only as described elsewhere in this Article.
II. Schools, community partners, and program collaborators. We may share information with schools, nonprofit organizations, community partners, mentors, instructors, venues, and other collaborators when reasonably necessary to coordinate a program, event, grant, or partnership and subject to appropriate safeguards.
III. Professional advisers and legal reasons. We may share information with legal, accounting, insurance, audit, and other professional advisers, or when reasonably necessary to comply with law or legal process, protect rights or safety, investigate misuse or security incidents, or respond to an emergency.
IV. Organizational transactions. We may transfer information in connection with a merger, financing, reorganization, transfer of operations, or similar transaction involving Wayfarer Pathways.
V. With direction or consent. We may share information when you ask or authorize us to do so, or as otherwise disclosed when the information is collected.
VI. No sale, rental, or barter. We do not sell, rent, or barter personal information for money or other direct consideration, and we do not consider our sharing to be a “sale” or “sharing” of personal information, or processing for “targeted advertising,” as those terms are defined under applicable state privacy laws. If any analytics, advertising, or similar activity is nonetheless treated as a sale, sharing, or targeted advertising under applicable law, we will honor any applicable opt-out right as described in Article 7.
Article 5 — Youth and Children’s Privacy
I. Website audience. The general Website is not directed to children under 13, and we do not knowingly collect personal information directly from children under 13 through the general Website without legally sufficient authorization.
II. Youth programming. Some Wayfarer Pathways programs serve middle school or high school students. Program-specific forms, notices, and releases may supplement this Privacy Policy. Where required, we obtain information and consent from a parent or legal guardian before collecting, using, or disclosing a minor’s personal information.
III. Limited collection. We seek to collect only information reasonably needed to administer youth programming, communicate with families and partners, provide accommodations, protect safety, document participation, and meet legal obligations.
IV. Photos, recordings, and student work. We may request separate permission before using a minor’s image, voice, likeness, statements, creative work, or participation information for publicity, social media, fundraising, or promotional purposes.
V. Parent or guardian requests. A parent or legal guardian may contact us to ask about, correct, or request deletion of a minor’s personal information, subject to applicable law and legitimate program, safety, and recordkeeping needs.
VI. Applicable children’s and student privacy laws. Where applicable, our collection, use, and disclosure of information about minors may be subject to the federal Children’s Online Privacy Protection Act (COPPA), including when personal information is collected online from children under 13. If Wayfarer Pathways operates an online service for K through 12 school purposes or receives student information from or on behalf of a school or school district, the Illinois Student Online Personal Protection Act (SOPPA), the Family Educational Rights and Privacy Act (FERPA), contractual requirements, or other student privacy protections may also apply. In those circumstances, we will use covered student information only for authorized purposes and will comply with applicable data-sharing agreements and legal requirements.
VII. Inadvertent collection and deletion. If we learn that we have collected personal information from a child under 13 (or another applicable age under law) without the required parental or guardian consent or other legally sufficient authorization, we will promptly take reasonable steps to stop further collection and to delete that information from our records, unless we are required or permitted by law to retain it. A parent or legal guardian who believes we may have collected a child’s information without appropriate consent may contact us at info@wayfarerpathways.com so that we can review the matter and, where appropriate, delete the information.
Article 6 — Cookies and Analytics
I. How these technologies are used. We may use cookies, pixels, tags, scripts, local storage, and similar technologies to operate and secure the Website, remember settings, understand traffic and usage, diagnose technical issues, and evaluate communications or outreach.
II. Your choices. Most browsers allow you to block or delete cookies or receive notice when cookies are sent. If you disable cookies, some Website features may not function as intended.
III. Privacy signals. Some browsers transmit “do not track,” Global Privacy Control, or other universal opt-out preference signals. We respond to these signals as required by applicable law. Our response may depend on the signal used, the browser or device settings, whether the signal can be associated with your browser or account, and the legal requirements that apply.
IV. Categories of cookies and analytics technologies. We may use strictly necessary technologies that are essential for the Website to function, functional technologies that remember preferences and settings, and analytics services that help us understand Website traffic and evaluate our communications and outreach. These technologies may be provided by third parties that set their own cookies or similar technologies and collect, use, and disclose information under their own privacy policies. We will update this Privacy Policy as necessary.
Article 7 — Your Choices and Privacy Rights
I. Communications. You may unsubscribe from promotional emails using the unsubscribe option in those emails. We may still send administrative, program-related, legal, security, or other nonpromotional communications.
II. Rights that may apply. Depending on where you live and the law that applies, you may have rights to confirm whether we process your personal information, access it, correct it, delete it, obtain a portable copy, or opt out of certain targeted advertising, sale, or sharing activities.
III. Submitting a request. You may submit a privacy request by contacting us at info@wayfarerpathways.com. We may need to verify your identity or authority before responding. Rights are subject to applicable exceptions, and we will not unlawfully discriminate against you for exercising an applicable privacy right.
IV. Sale and targeted advertising. We do not sell, rent, or barter personal information for money or other direct consideration. If applicable law treats any analytics, advertising, or similar activity as a sale, sharing, or targeted advertising, you may contact us at info@wayfarerpathways.com to exercise any applicable opt-out right.
V. State privacy laws and notices. The privacy rights available to you depend on your state of residence and the law that applies. Comprehensive consumer privacy laws in states such as California, Colorado, Connecticut, Virginia, Utah, and other states that have enacted such laws may provide rights to access, correct, delete, or obtain a copy of personal information and to opt out of certain sale, sharing, or targeted advertising. Illinois currently has no comprehensive consumer privacy statute providing general access, correction, or deletion rights; accordingly, those rights apply to residents of states that grant them. Illinois residents may have rights under specific Illinois laws, such as the Biometric Information Privacy Act, where applicable.
VI. Verification and authorized agents. Before responding to a privacy request, we may need to verify your identity or, if the request is submitted on your behalf, the authority of your authorized agent. Where permitted by applicable law, you may use an authorized agent to submit a request; we may require the agent to provide proof of authorization and may require you to verify your identity directly with us.
VII. How we respond and appeals. We will respond to verifiable privacy requests within the timeframe required by applicable law and may extend that timeframe where the law permits. If we decline to act on your request and applicable law provides an appeal right, you may appeal our decision by contacting us at info@wayfarerpathways.com, and we will respond to your appeal as required by applicable law.
Article 8 — Data Security
I. Safeguards. We use reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, disclosure, alteration, or destruction.
II. No absolute security. No website, internet transmission, email system, or electronic storage system is completely secure. We cannot guarantee that personal information will never be accessed, used, or disclosed without authorization.
III. Incident response. If a security incident triggers notice obligations under applicable law, including the Illinois Personal Information Protection Act (815 ILCS 530), we will investigate and respond without unreasonable delay and provide legally required notices to affected individuals, the Illinois Attorney General, regulators, or others in the manner and within the timeframes required by applicable law.
Article 9 — Retention
I. How long we keep information. We keep personal information for as long as reasonably necessary to operate the Website, administer programs and partnerships, evaluate or manage philanthropic initiatives, communicate with participants and partners, comply with legal obligations, resolve disputes, maintain security, and keep appropriate business records.
II. Deletion or de-identification. When information is no longer needed, we may delete it, de-identify it, aggregate it, or retain it as required or permitted by law.
III. Retention criteria. The criteria we use to determine retention periods include the nature and sensitivity of the personal information, the purposes for which it was collected, the duration of our relationship with you or a partner organization, applicable legal, tax, audit, grantmaking, and recordkeeping obligations, the existence of any pending or anticipated dispute or legal proceeding, and applicable statutes of limitation.
IV. Biometric information. To the extent Wayfarer Pathways collects, captures, or stores any biometric identifiers or biometric information as defined by the Illinois Biometric Information Privacy Act (740 ILCS 14), we will retain such information only as long as reasonably necessary and will permanently destroy it when the initial purpose for collecting or obtaining it has been satisfied or within 3 years of the individual’s last interaction with Wayfarer Pathways, whichever occurs first, in accordance with a publicly available written retention schedule and guidelines for permanent destruction.
Article 10 — Third-Party Websites and Services
I. Third-party services. The Website may link to or rely on forms, email platforms, analytics tools, social media, video or media platforms, mapping tools, accessibility tools, and other third-party services.
II. Their privacy practices. Third parties may collect, use, retain, and disclose information under their own privacy policies and terms. We are not responsible for the privacy practices of websites, platforms, organizations, or services that we do not control.
III. International visitors and data transfers. Wayfarer Pathways is based in Illinois, in the United States, and we operate the Website and process personal information in the United States. If you access the Website or provide personal information from outside the United States, your personal information may be transferred to, stored in, and processed in the United States, where privacy laws may differ from those in your location. Where required by applicable law, we will use an appropriate legal mechanism for the transfer.
